INTRODUCTION
The Environment (Protection) Act 1986, has important constitutional implications, with an international background. The Act clearly drew its inspiration from the proclamation adopted by the United Nations conference on the Human Environment which took place at Stockholm from 5th to 16th June 1972, in which the Indian delegation led by the then Prime Minister of India took a leading role.
The protection and improvement of the human environment is a major issue, which affects the well being of people and economic development throughout the world; and the duty of all Governments.
The gravity of seriousness attached to the environmental problem is evident from the fact that in all advanced countries, scientists, economists, policy-makers and administrators, have given serious thought to such problems. The developing, and even underdeveloped nations urgently need to address themselves to this devastating problem.
